At Frank Gay Services, every qualifying HVAC system we install comes with our 30% Utility Savings Guarantee.
If your new heating and cooling system doesn’t reduce your energy costs by at least 30% within the first year of installation, we’ll pay you double the difference. This guarantee is based on your home’s energy consumption history from the twelve months before installation (the “Base Year”) and applies for one full year following the date of installation (the “Annual Period”).
Savings are calculated using your utility’s energy rates, excluding taxes, surcharges, and other provider fees. This guarantee becomes valid only after full payment under your original sales agreement has been made.
How to File a Claim
If your energy savings fall short of 30% during the first year after installation, contact Frank Gay Services with a brief description of your concern. Claims must be filed within 400 days of installation.
You will need to provide:
- A copy of this Utility Savings Guarantee
- Your original sales agreement or purchase order
- Energy bills from the twelve-month Base Year and the full Annual Period after installation
Once your claim is received, Frank Gay Services will schedule an inspection within a reasonable timeframe to verify performance and calculate your results.
If your system’s energy savings are confirmed to be below 30%, we’ll reimburse you 200% of the difference based on the energy rates at the time of installation. In some cases, Frank Gay Services may also inspect or meter your home’s system to confirm usage and may make reasonable adjustments to restore system performance.
Energy consumption will be compared year over year, excluding unrelated factors such as pool heaters or hot tubs, and adjusting for any significant changes to your home’s structure or occupancy.
Owner Responsibilities
Your energy management habits directly impact system performance and savings.
To maintain this guarantee, you agree to:
- Keep windows and doors closed while heating or cooling your home
- Follow manufacturer instructions for proper system operation and maintenance
- Replace filters and schedule annual inspections as recommended
- Set thermostats no higher than 72°F in heating season and no lower than 72°F in cooling season
Frank Gay Services reserves the right to deny reimbursement if material changes, such as renovations, system alterations, or occupancy changes, significantly affect your home’s energy use or performance.
What’s Not Covered
This guarantee applies only to the original homeowner and assumes normal, responsible use of your Frank Gay Services-installed system.
It does not cover:
- Structural or foundation issues
- Unauthorized repairs or system modifications
- Damage from incompatible accessories
- Natural disasters (hurricanes, floods, lightning, earthquakes, etc.)
- Environmental or chemical corrosion
- Fire, vandalism, or intentional damage
- Failure to maintain or clean the equipment properly
This guarantee does not extend to any damages or performance issues beyond the control of Frank Gay Services.
Additional Terms & Conditions
Any installation, removal, repair, or tampering performed by someone other than Frank Gay Services immediately voids this guarantee.
This document represents the entire agreement between Frank Gay Services and the homeowner regarding this Utility Savings Guarantee and supersedes any prior communications or promises. No employee or representative may modify or add to these terms.
In the event of a dispute, either party may request confidential, binding arbitration through the National Arbitration Forum. All claims must be made individually and not as part of a class action or group proceeding.
